Our alleged, “stem cell therapy product” case was sold to us via a “Bait and Switch” sales technique used by both a Doctor of Chiropractic and a MD, where they present a stem cell sales pitch describing a developing fetus such as when stem cells are morphing into bone, cartilage, vascular tissue, tendons, ligaments, vertebrae and blood cells, also known as “the bait” and then make blanket unproven statements about how their product has many more stem cells than most older people's bone marrow and state that their product morphs or "homes" into whatever the body needs based on where and how the product is introduced into the body. The purported "stem-cell" product can be introduced either through a trigger point injection to regenerate joints, vertebrae or nerves or through a slow-push IV (whereby the chiropractor in our case decided between the injection vs the IV, not the MD) for things such as diabetes or ulcerative colitis and more, as a "miracle cure for anything." These particular snake-oil salesmen cleverly disguised as a chiropractor and a MD also cite their own self-created clinical studies(where none exist) while employing the “switch” to their product and deceptively stating that their product contains living and functional stem cells(see picture of conversation below) when , by the FDA 361 Registration that their product has, means that there are no living stem cells in the human cellular tissue product (HCT/P) or the product would have to be a FDA Approved 351 Drug if it contained living stem cells as indicated under the FDA 361 Registration for HCT/P vs FDA 351 Drug Approval that is needed for “live” stem cells. Under the Florida Deceptive and Unfair Trade Practices Act, the fact that the DC and the MD used the “Bait and Switch” technique to misrepresent to us what they were allegedly selling as “live and functional stem cells,” triggers both fraud and deception under the FDUTPA, since the product they stated we were getting contained live stem cells (see documentation of what they stated to us, attached) and by their product's own FDA 361 Registration, did not, as only FDA Approved 351 Drugs can contain living stem cells. In addition, we believe that the MD used this 361 Registered Human Cellular Tissue Product inconsistent with the “homologus only” way stated for it’s use in the practical applications guide(attached) sent to doctors for the application of the products as the MD combined PRP with the HCTP product and injected it into both of our backs and into the right hip and knee of one person and then into another person as an IV injection, twice for diabetes, ulcerative colitis, dementia and more. We were deliberately deceived and taken advantage of by this DC and MD and robbed for approximately $30,000 dollars combined between our 3 family members that fell victim to this scam. Furthermore, upon research, Prior to July 1st 2017, 10 days AFTER we received these experimental HCT/P 361 Registered ( we were not told this product was experimental), combined with PRP and injected into us via blind trigger point injections at a chiropractic clinic in Florida, Floridians could not receive experimental treatments.
Upon reviewing additional research on laws protecting the public from unscrupulous doctors abusing their oaths to “do no harm,” the RICO Act that makes it “unlawful to acquire, operate or receive income from an enterprise through a pattern of racketeering activity” through white collar crime exploiting their positions as a physician and/or DC, as the MD is registered in at least 4 states and is associated with at least 4 or more clinics, that may qualify the activity as an established “pattern” of deceptive practices and fraudulent claims in order to rob people of their assets under the guise of a medical doctor using his “Bait and Switch” practices and making false claims of proven clinical research based on a clinically unproven product in their sales seminars, to people individually to sell their product and via mass emails (that also violate HIPPA) among his/their patients by email sharing 233+ emails between their patients. We met the DC at a conference in the Tampa area in May 2017, where he introduced us to “stem cell” information and said that he and another MD, perform stem cell treatments locally. He stated that he had healed his bulging discs with this “stem cell therapy” and that he was getting stellar results with his patients by combining “stem cell therapy” treatment with the BeMer and he said that he sold the Bemer with his alleged “stem cell therapy” as a "package" in order to “optimize the treatment” of the purported "stem cells" which also triggered us to purchase a $6,000 Bemer when we purchased the purported "stem cell therapy" as he insisted that this increase in circulation created by the BeMer was necessary so that the “living stem cell therapy” that he and the MD would provide would also increase the benefit of the alleged “stem cell” results.
We visited with the DC and his wife to learn more. The DC said that he wanted to help us and said that he would be willing to do his “stem cell” treatment for both of us “at his cost” because he wanted to help us. His “at cost” would be $8850.00 for one and $4500.00 for the other, which was decided on our phone consultations with the DC, who recommended that we each do trigger point injections for our spines ( Cervical, Thoracic, Lumbar and Sacral) and for a right hip and a right knee instead of stem cell IVs. The DC, a very skilled salesman utilizing some of the most underhanded “perception” based marketing skills created by gaining someone’s trust as a DC, in conjunction with an MD, made a lot of claims about what his “stem cell” therapy would do for us, including reducing neuropathic pain and weakness, re-grow nerves that were damaged, heal annular tears in the discs, heal facet joints in our vertebrae, as well as repair some of the damage from degenerative disc disease and arthritis, as well as bulging discs and heal hip and knee pain from arthritis. We were very hopeful since we had heard first hand from the DC and MD about the “miracles” that stem cells are turning out in many people, especially their patients because they mix your own blood platelets with a mix of amniotic and umbilical cord “stem cells” made by a certain company(now recalled) and then inject it all mixed up together into the spine areas and hip and knee joints. The DC explained that he did not even need to look at our medical records or MRIs to see how bad our spine condition was because the “stem cells” would “home” in the areas that needed healing the most and go to work. He also stated to expect a noticeable reduction in inflammation almost immediately and that the “stem cells” would continue to multiply and work for up to 2-3 months and that they would have their full “effect” within that time and keep multiplying and working for up to 5-6 months.
We were so excited about what the doctors were claiming, that their “proprietary” mix of PRP and amniotic and stem cell umbilical cord products could do, that our 77 year old relative, suffering from ulcerative colitis, stomach and bowel control issues, diabetes, memory issues and an early stage Alzheimer's diagnoses, wanted to consult with the DC and MD about what these “stem cells” might do for him. Our Senior relative, along with his wife, spoke with the DC for the closing medical evaluation and recorded the call so that the son could hear it since he has memory issues and his son is his POA. The chiropractor recommended a slow-push IV for our senior relative and said that he would need to do it twice for a total of $20,000 for the 2 “stem cell” treatments to work for him. He also mentioned that he may need to do it a third or fourth time as well as freely providing medical advice even though he is not an MD. He stated proven medical results for people with our Senior’s issues.
The DC decided to give our senior relative a “deal” and charge him $16,000 for 2 IV injections. Same “deal discount” that he used his snake oil sales skills to close us. Because they were expert deceptive salesmen armed with a DC and a MD degree and trained with gaining trust and exploiting people for their money and even making false claims about what their product even contains in order to make a sale to profit from people already in pain, disabled veterans and elderly (as in our case)and due to the increase in our pain and need for additional treatment to counter the side effects of the unproven experimental dead tissue product that was possibly contaminated, as well as no improvement in anyone’s issues as they claimed, plus the fact that no one knows the long term effects of such products coupled with peer research by Dr. Chris Centeno and more as can be read by the links listed,documented conversations and recorded sales calls, and FDA Laws, we believe that we have a case worth pursuing that will help others who may be at risk for being taken advantage of by unethical physicians and chiropractors that prey on people at a severe physical, disabled, elderly disadvantage and with chronic issues.
